OFFICIAL BUD LIGHT “FAILOWEEN” CONTEST RULES
IMPORTANT: PLEASE READ THESE OFFICIAL RULES AND REGULATIONS BEFORE ENTERING THE 2020 BUD LIGHT “FAILOWEEN” CONTEST (THE "CONTEST"). BY ENTERING THE CONTEST, AN ENTRANT REPRESENTS THAT HE OR SHE SATISFIES ALL OF THE ELIGIBILITY REQUIREMENTS BELOW AND AGREES TO BE BOUND UNCONDITIONALLY BY THESE OFFICIAL RULES AND REGULATIONS AND ALL DECISIONS OF THE CONTENT OPERATOR (defined below). THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, TWITTER. FACEBOOK, AND/OR INSTAGRAM. THE PARTICIPANT, IN ENTERING, IS UNABLE TO HOLD TWITTER, FACEBOOK AND/OR INSTAGRAM LIABLE FOR ANYTHING THAT COULD TRANSPIRE DURING THE COURSE OF THE CONTEST.
NO PURCHASE NECESSARY TO PARTICIPATE. Must be 19 years of age or older and a legal resident of Canada (excluding Quebec) to participate in the Contest. Entrant participation shall be subject to and construed in accordance with the laws of Canada.
ADMINISTRATION: The Contest is operated by Labatt Brewing Company Limited, 207 Queens Quay West, Suite 299, Toronto, Ontario M5J 1A7 (“Labatt” or the “Contest Operator”). The decisions of the Contest Operator are final and binding in all matters as they relate to the Contest, including without limitation eligibility and/or disqualification of entries.
ELIGIBILITY: To be eligible to win a prize, you must: (i) be 19 years of age or older and; (ii) be a legal resident of Canada (excluding Quebec); (iii) not be a member of the immediate families of an employee, contractor, agent or representative of the Contest Administrator, or any of its respective parent companies, subsidiaries, affiliates, agencies, distribution companies, the applicable liquor authorities, participating liquor licensees, prize suppliers, or any of their respective shareholders, trustees, directors, officers, employees or agents, or any person who is domiciled with any of the foregoing persons. For the purpose of the Contest “immediate family” is defined as parent, spouse, sibling, child or any person residing in the same household or domiciled with any such employees or representatives. The Provincial Liquor Authorities are not connected with this contest in any manner whatsoever and are not liable in any way whatsoever in regard to any matter which relates to this contest. This contest is in no way sponsored, endorsed or administered by, or associated with the Provincial Liquor Authorities
CONTEST PERIOD: Contest starts on or about October 8, 2020 at midnight EST and closes on October 20, 2020 at 11:59 pm EST (the “Contest Close Date”). Winner will be announced between October 28, 2020 at 11:59 pm and October 29, 2020 at 11:59 pm.
HOW TO ENTER & HOW TO WIN: To participate in the Contest, entrants must have Internet access, a valid Twitter, Facebook or Instagram account, a valid email address and must follow the Bud Light social handle on submission social platform of choice. There is one way to enter, as set out below. No other method of entry will be accepted. Content must adhere to the guidelines set out below.
During the Contest Period, participants can enter the contest by posting their failed Halloween costume picture submission to their Twitter, Facebook or Instagram account. All submissions must include the hashtag #Failoween and tag @budlightliving/@budlightca and must adhere to the Photo Guidelines outlined below in this section. Note that the social platform used to post the video submission must have the profile settings set to public.
- Photo must depict a failed Halloween costume (preferably homemade);
- All content must have been taken by the entrant;
- Entrant must have obtained all necessary rights and permissions;
- Content cannot depict any consumption of alcohol, nor any reference to irresponsible consumption;
- Content cannot show any dangerous activities or use inappropriate, obscene or otherwise offensive images and/or copy;
- Any people depicted in photo must be of legal drinking age.
- Costumes that have particular appeal to minors may be disqualified.
Please follow provincial and local guidelines to help maintain a safe and responsible environment.
All eligible submissions will be judged by a contest judging panel (as determined by the Contest Operator), who will select one photo based on:
- The Photo Guidelines outlined above;
- Great idea and commitment to details that ultimately failed in execution;
- Humour / entertainment level;
- Attempt to make the most out of a costume with minimal dollars spend (for example, homemade vs. store-bought).
The Contest Operator reserves the right to disqualify an entry for any reason whatsoever at its sole discretion. All decisions of the Contest Operator and/or the judging panel shall be final and shall not be subject to appeal.
Selected potential winner will be contacted via social media direct message with next steps and more information.
By submitting a photo in this contest, you agree that your photo (in whole or in part, edited or otherwise) may be shared by the Contest Operator across Bud Light Canada’s social media platforms and YouTube channel and/or in other social media advertising and may be commentated on by the judges and/or the Contest Operator.
GRAND PRIZE: There is one grand prize available to be won consisting of a Bud Light costume and $4,000CAD (payable to the winner only by prepaid credit card). Approximate retail value of the grand prize is $4050CAD. The odds of winning a grand prize depend on the number of eligible entries received and the decisions of the Judging Panel.
The Grand Prize must be accepted as awarded. The Grand Prize is non-transferable and nonredeemable for cash. No substitutions, except by the Contest Operator, who reserve the right to substitute a Grand Prize or any portion of a Grand Prize with a prize of equal or greater value. All decisions of the Contest Operator shall be final and shall not be subject to appeal.
AWARDING OF GRAND PRIZE: Selected entrant will be notified by the Contest Operator via social media direct message within twenty-four (24) hours following the Contest Close Date. If the entrant has not responded within forty-eight (48) hours, another entrant may, at the Contest Operator’s sole discretion, be selected in which case that entrant will become the selected entrant and the previously selected entrant then will be disqualified and have no right to any prize.
In order to be declared a Grand Prize winner, selected entrant must comply with these Official Rules and Regulations, must correctly answer a mathematical skill-testing question without assistance administered by the Contest Operator and must sign and return with a designated time period a declaration and waiver confirming (i) acceptance and compliance with these Official Rules and Regulations (ii) releasing the Contest Operator, its employees, directors, officers, governors, shareholders, trustees, affiliates, representatives, parent companies, subsidiaries, professional advisors, and advertising and promotional agencies (collectively, the "Released Parties") from any and all liability arising out of, pursuant to, or as a result of the carrying out of the Contest, or any part of the Contest, including, without limitation, liability arising from the acceptance of and usage of the Grand Prize as awarded, the administration of the Contest and the selection of any potential winners.
No communication will be entered into by the Contest Operator with entrants except with selected entrant(s). The Contest Operator is not responsible for the failure, for any reason whatsoever, of a selected entrant to receive notification or for the Contest Operator to receive a selected entrant’s response. By entering any part of the Contest, all entrants, should they win, agree to the use of their name, social media handle, address (city only), photo, and/or image on videotape, and video submission in it’s entirety or in part for publicity and promotional purposes without compensation.
OWNERSHIP OF ENTRIES: All entries and materials submitted to the Contest Operator in connection with the Contest (collectively, "Entry Materials"), along with all copyright, trademark and other proprietary rights associated therewith, become the property of the Contest Operator upon submission, and Entry Materials will not be returned to any entrant.
RELEASE: By participating in the Contest and submitting an Entry, each entrant (i) agrees to be bound by these Official Rules and Regulations, including all Entry requirements, (ii) agrees that the decisions of the Contest Operator is final and without appeal, (iii) remises, releases and forever discharges the Contest Operator from any and all actions, causes of actions, suits, debts, dues, accounts, claims, damages, liability, losses, harm, costs or expenses, including without limitation any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, arising out of, or in any way related to, directly or indirectly, the Contest, including without limitation the entrant’s participation in the Contest, any breach of these Official Rules and Regulations, the awarding, receipt, possession, use and/or misuse of any Contest prize (or any portion thereof), and any travel or activity that is related to the receipt or use of any Contest prize, and/or the violation or infringement of any intellectual property rights or of any publicity, personality or privacy rights, and agrees to fully indemnify the Released Parties from any and all claims by third parties relating to the foregoing.
LIMITATION OF LIABILITY: The Released Parties shall not be liable for any damages caused or alleged to be caused by or resulting from: (i) any entry, prize or other correspondence or data that is lost, stolen, late, garbled, distorted, delayed, damaged or misdirected for any reason; (ii) any failure, interruption, technical malfunction or delay; (iii) any e-mail, text or SMS message or other communication sent or received to or from the Contest Operator or any of its agents or designees, for any reason; for any incorrect, untimely or inaccurate information, whether caused by a website, users or by equipment or programming errors associated with or utilized in the Contest; (iv) any technical or human error which may occur in the processing of any entry or entries in the Contest; (v) for problems with the function of any website or website feature, howsoever caused; (vi) the malfunction of, or damage caused to, any telephone network or lines, computer equipment, data, software, online systems, servers or access providers; (vii) any functionality lost due to not having cookies enabled; (viii) for traffic congestion on the Internet; (ix) the security or privacy of information transmitted via computer networks; (x) breaches of privacy due to interference by third party computer "hackers" or for any damage caused to or incurred by any entrant or any other person by reason of any such event or occurrence; or (xi) technical, hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmissions including lost, misappropriated or corrupted entries, virus, worm or Trojan Horse damage or any other damage which may limit a participant's ability to participate in the Contest.
ERRORS: The Contest Operator are not responsible for typographical or other errors in the offer or administration of the Contest, including but not limited to errors in advertising, the Official Rules and Regulations, the selection and announcement of winners, or the distribution of any prize. The Contest Operator reserves the right to terminate the Contest or change these Official Rules and Regulations at any time, at its sole discretion without prior notice.
RIGHT TO TERMINATE, MODIFY OR SUSPEND: The Contest Operator may at any time, at its sole discretion and without liability, terminate, modify or suspend the Contest in whole or in part, subject only to approvals required by law, if fraud, technical failures or communications or any other errors or other causes beyond the control of the Contest Operator corrupt the administration, integrity or security of the Contest or if any other factor interferes with the conduct of this Contest as contemplated by these Rules. Without restricting the generality of the foregoing, in the event of early termination of the Contest, a notice will be posted on the Contest Website to that effect. In addition, for the purposes of determining eligibility to win a Prize in the event of early termination of the Contest, all eligible entries received prior to the time of early termination will be considered as valid and for the purposes of these Rules, the Contest Period will be deemed to have ended at the moment of early termination. The Contest Operator reserves the right, at any time, in its sole discretion, to correct any errors, including without limitation, any typographical, printing, computer programming or operator errors. No waiver on the part of the Contest Operator to enforce of any term herein shall be deemed a continuing waiver or a waiver of any other term.
DISQUALIFICATIONS: The Contest Operator reserves the right at its sole discretion to disqualify any individual who is found (i) to be tampering with the entry process or the operation of the Contest; (ii) to be acting in violation of the Official Rules and Regulations; (iii) to have submitted an entry that is not compliant with these Rules; or (iv) to be acting in an un-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY ENTRY OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST OPERATOR RESERVES THE RIGHT TO DISQUALIFY SUCH ENTRANT OR INDIVIDUAL AND SEEK DAMAGES OR ANY OTHER REMEDY FROM ANY SUCH ENTRANT OR INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
